Why Evening Sessions

Tacitskills is a company that caters to busy professionals by offering live interactive courses that take place in the evenings between 19:00 and 22:00. This allows professionals to continue working on important projects during the day and complete the course in the evenings. To make the most of their time, the courses are split into 3 hour sessions per evening, rather than requiring professionals to take time off work to attend full-day training sessions. About This Course

This course is accredited and approved by the Engineering Council of South Africa (ECSA). On Completion professionals will earn 2 ECSA CPD Points as well as PMI Certificate holders will be eligible to claim 14 PDUs from the Project Management Institute (PMI). This course aims to provide a comprehensive understanding of the terms, conditions, and procedures outlined in the JBCC PBA contract. It is designed to be practical and interactive, using templates, case studies, and examples to make the procurement, management, and administration of JBCC contracts easier. The course will be facilitated by an expert with years of experience working with these contracts and advising clients. The focus will be on the JBCC PBA contract, but attendees will also be able to gain an understanding of the JBCC N/S Subcontract. The goal of the course is to help attendees become proficient in implementing and working with these contracts.

A detailed look at the course contents that will be covered:

  • Session 1: Procuring a JBCC contract. This session will cover the role and responsibilities of the principal agent in preparing the contract documents, including the Contract data EC and pricing documents.

​

  • Session 2: General provisions of the contract. This session will focus on important definitions and other terms of the contract, as well as clauses related to procedures and the giving of notices.

​

  • Session 3: Role of the Principal Agent in administering the contract. This session will delve into the role and responsibilities of the Principal Agent, including the giving of instructions, issuing of payment certificates, and certifying practical, work, and final completion.

​

  • Session 4: Payment provisions. This session will cover the procedures for submitting applications for interim and final payments, as well as the applicable payment procedures and terms.

​

  • Session 5: Variations. This session will discuss the reasons for and extent of variations that may be ordered, as well as the procedures for dealing with the time and cost implications of variations. The valuation of work that has been executed and the adjustment of rates and revision of the lump sum price due to variations will also be examined.

​

  • Session 6: Contractor’s claims for a revision of the Practical Completion Date and/or for a revision of the Contract Price. This session will cover the procedures for notification and submission of claims for additional time and cost, as well as the manner in which claims must be quantified and the use of contemporary and other records. The events that give the contractor a right to claim, including force majeure events and delays attributed to the employer, will also be discussed. Tips and guidance on how to prepare and submit claims correctly will be provided to reduce the risk of claims being rejected or dismissed.

  • Session 7: Quality control. This session will examine provisions related to quality control, defective workmanship, liability for errors in the design, tests, practical, works, and final completion, as well as the latent defects liability period.

  • Session 8: Dispute resolution and claims. This session will address the reasons for the prevalence and high incidence of disputes and how to potentially avoid them. The appointment, role, and function of the adjudicator and other dispute resolution mechanisms will also be discussed.

A live webinar training is an interactive course that is conducted online in real-time. This accredited course will provide attendees with 3 months of access to recordings for review purposes after the live session has ended

Instalment Option

The option to pay for this course in two installments is available for professionals. The full balance must be paid in full seven days prior to the start of the course. If the balance is not paid before the start of the course, the delegate will not be permitted to attend the course and no refunds will be issued. It is important to note that all installment options are non-refundable. Please note that the installment option is only valid for professionals who register for the course more than two months in advance. If you register for the course less than two months in advance and have only one month remaining until the start of the course, the installment option will not be available and you will need to pay the full price.
